Injuction on Arizona immigration law

I’m puzzled by headlines such as one at memeorandum, that reads “Arizona immigration law: Key parts struck down by judge.” In fact, however, the article in question describes the judge ordering a temporary injunction pending further court rulings on the matter.

I believe that this case is almost inevitably destined for the Supreme Court anyway. Till then there will be a series of rulings. This one merely suspends some of the more controversial aspects of the law until courts rule further on the merits.

    Good thing I read Neo’s blog !

    I didn’t know this.

    Thanks Neo !

  2. Tom Says:

The judge could have upheld the law; the effect on appeals would have been unaltered. Now it goes to the Ninth Circuit, which will uphold. So today’s ruling is material in terms of immediate impact on its enforcement, and that ain’t beanbag.

  3. br549 Says:

As we have known is coming, States’ rights are in jeopardy. Interesting times, indeed.

  4. LibertyAtStake Says:

This illegitimate ruling goes beyond the pale of merely waiting for the appeals to correct it. It should be ignored by Arizona under the natural right of civil disobedience and the rights reserved to the states under the 9th and 10th amendments.

Once again, the Ninth Circuit will set itself up to be over-ridden. Once again, we will be glad (or not) for Anthony Kennedy.

I don’t know. It looks to me as though this is really rousing people. Something had better. Anyone who thinks we’re still in “business as usual” mode needs to think again.

Things are moving quickly, and this is simply the most visible of moves the wizards are making. There’s also the placement of the SEC behind a “No Freedom of Information Act” firewall and the DOJ’s refusal to enforce the new Military and Overseas Voter Empowerment Act. I’m all for the Republicans being just the party of “No.” At this point, someone needs to be.

This visit may depress his poll numbers even more.

It’s about the agenda of the left being the virus for this country.

This country needs government to get out of the way – spreading opportunity – not squelching it.

To me it isn’t about Obama. But….. I’m glad that he’s doing this kind of stuff and reducing his poll numbers.

  7. betsybounds Says:

    Baklava,

You make a good point, of course–it seems as though the more we see of Obama, the less we like him. I thought some time ago, and so did some others here, that these wizards don’t seem to care whether they’re popular among the electorate or not. They make noises sounding like they do, but mainly they just keep on running us down and laughing about it. There’s some reason for that, and I’m back to entertaining the possibility that there will come some move to suspend the elections–that, or a very well-organized effort to steal them. I had written such a possibility off for a while.

I don’t know the stats on the matter, but I heard Rush say today that the tourist trade in Arizona is booming since they passed their immigration law–this, in spite of Leftist interest groups’ massive efforts to engineer highly publicized Arizona boycotts. It’s all propaganda, all the time. We’ve got our own American Pravda operating now, one bureau of which is named JournoList. I keep remembering that, once upon a time not that long ago, Rush was very vocal about not putting any stock in conspiracy theories. Every now and then I think I’d like to ask him whether he’s changed his mind at all on that.

What are we going to do? I don’t know. I keep thinking–fearing, really–that it’s going to take a really huge Democrat defeat to put a dent the attacks we’re being subjected to on such multiple fronts. Failing that, I hate to think of what we might be forced into.

“Arizona immigration law: Key parts struck down by judge.”

Headlines like this are not meant to impart an objectively accurate understanding to the reader. They are meant to establish a meme, in this case in support of a gradual but accelerating deterioration in states rights. The left is doing this for obvious reasons, states frequently act as barriers to implementation of the left’s agenda.

Increasing the reach of the federal government is critical to the left’s agenda and that requires that any area where state rights impede upon that agenda be countered.

The US Constitution, which empowers the states is simply the greatest barrier to that agenda and thus must be attacked through every available venue and tactic.

Attack the authority of the states and you attack the Constitution by ‘evolving it’ into something unrecognizable; a ‘living document’ that effectively denies individual liberty in favor of “social justice”. ‘Justice’ that conveniently and permanently leaves the left with the power to define political correctness and acceptable social policy.

  9. Tom Says:

    betsy:
I see no alternative to a reverse Cloward-Pliven, a massive refusal to play by the rules imposed by the Left. Massive refusal to pay taxes (especially sales and property), the return to an all-cash payment and barter for transactions. Screw the 1099s for all business transactions over $600. It will take a lot of steady souls to make this happen.
My small business vendors are already often happy to grant a 15-20% discount for cash. I am happy to oblige.

  10. Artfldgr Says:

Other states are not going to sit by and let them turn the most powerful country into a dictatorship of the people, which tends to move towards a war socialism. if not, then there wont be enough economy and experience to make whats needed domestically.

if you look at everything written, it ignores the outer other. either because that’s the guiding hand, or because they don’t think that what they do changes the situation umbrella they think they are under.

they have nationalized a lot more than we realize.
and GM is now buying companies. think for a second as to how they are too big to fail as we own them. and so now they can swallow up others? for each they do the state ownership expands. no?

  11. jon baker Says:

Perhaps the states need to refuse to help Federal officers enforce all National laws until such time as the Federal Government comes to its senses.

  12. jon baker Says:

This may very well be the 1850′s all over again. Except this time it may be the large cities verses the less populated areas. The US Federal Government and the Mexican government against the bitter clingers.

  13. jon baker Says:

Why do the Mexicans maintain 50 +/- consulates in the US? Why does the Mexican government actively seek to keep the border open? Why do mexican officials now patrol in NY? It is colonization!

  14. Richard Aubrey Says:

    Jon baker
Figure it this way. The Mexicans who come here are the most energetic, pro-active, risk-taking, ambitious, daring, motivated people in the country.
If they weren’t allowed out (sent out) of Mexico, if they were restricted in their efforts to Mexico, the roof would come off in short order.

  16. Artfldgr Says:

Meanwhile, revealing tht the fall of th soviet union was a fall of the type con men used in supermarkets to gain something…

we Sovietized to be closer while they pretended..

problem is that they can go back to what they were at a command, and we cant.

    funny thing about purity… eh?

cant turn a pickle into a cucumber, can you? so some changes shouldnt have been tried.

i should point out that they are building up for a war… period… unless they know aliens are coming from another planet, they are gearig up to take advantage of the fact that economic collapse for internal purposes also means that there is a window where the patient will be unable to defend itself.

so even our leaders are usful idiots beleiving they are geniuses… (remember there were people who made auers and them before this period)

    as stated in many warnings…

Medvedev widens powers of KGB successor agency

    apnews.myway.com/article/20100729/D9H8LTJO1.html

Russia has broadened the authority of the Federal Security Service, the KGB’s main successor agency, giving it Soviet-style repressive powers in a move critics say could be used to stifle protests and intimidate government opponents.

seen in the bigger picture, we have a distracting move, which will keep our attention while they flank us as a population…

who are they building all this new equipment and bunkers and other things for? what ALWAYS happens before one side goes after another? build up… and acclimatization of behavior to dull reflexes.

one mag pulse and the whole place is done
we cant live when they turn the electricity and machines in our cages off.

  17. Artfldgr Says:

John, if the civil war of the 1800s was fought today…

Russia would strike us (through another expendable state). at the very least it would grab property that was unprotected…

such is how socialism works. cant redistribute wealth your gun hasnt obtained, can you?

  18. John Says:

“cant redistribute wealth your gun hasnt obtained, can you?”

That would explain why Barry says he is against gun control.

  19. NJArtist49 Says:

My immediate response to the ruling was to state that the judge has declared the will of Obama is greater than the law: his policies are now supreme over the law: this malefactor of “judge” has, until she is overturned [maybe; but its a long time until then -- even so, it will be a sufficient length of time in order for Obama to consolidate his position], made Obama Dictator.

    @Artfldgr

so even our leaders are useful idiots
As I keep saying, these useful idiots are creatures of the Soviets and as such are more likely to have believed the the Soviet propaganda; whereas, the originators of the propaganda knew it was false.

i should point out that they are building up for a war… period…

Whatever you think of God and prophecy, the invasion of this nation and its occupation by Russia has been foretold for several decades now: it has gotten to the point where the Russian’s invasion routes have been mapped out.
These prophecies are accompanied by others which indicate the Chinese along with the Japanese[!?] also invade. At least eight Central American and South American nations abet the invading armies: some by serving as bases for missile launches.

  20. Artfldgr Says:

    i dont tell prophecies.
    i deal with facts.

    and facts delineate conditions…

if conditions change, the facts do, and so does the potential outcome.

that is, what i say is going to happen hinged on empirical points, history, and family experience.

lets just say that when a neighbor starts stockpiling things that have only one purpose, they dont intend it as an exercise in boredom.

    by the way..
for those that were saying this isnt exactly like the nazi stuff… do they remember tht the puppet master behind this (not whats behind him), was a nazi simithizer that learned what he knows about power control morals and such from the same people my family learned history from?

KROFT: (Voiceover) To understand the complexities and contradictions in his personality, you have to go back to the very beginning: to Budapest, where George Soros was born 68 years ago to parents who were wealthy, well-educated and Jewish.

When the Nazis occupied Budapest in 1944, George Soros’ father was a successful lawyer. He lived on an island in the Danube and liked to commute to work in a rowboat. But knowing there were problems ahead for the Jews, he decided to split his family up. He bought them forged papers and he bribed a government official to take 14-year-old George Soros in and swear that he was his Christian godson. But survival carried a heavy price tag. While hundreds of thousands of Hungarian Jews were being shipped off to the death camps, George Soros accompanied his phony godfather on his appointed rounds, confiscating property from the Jews.

the rest sounds that what he learned from it was different than what my family learned.

    he doesn’t know he is a sociopath…

if he wasnt, he would not think that doing the samething to everyone in the world as revenge for not saving him, and his family, was the right answer.

KROFT: (Voiceover) And you watched lots of people get shipped off to the death camps.

Mr. SOROS: Right. I was 14 years old. And I would say that that’s when my character was made.

    KROFT: In what way?

Mr. SOROS: That one should think ahead. One should understand and — and anticipate events and when — when one is threatened. It was a tremendous threat of evil. I mean, it was a — a very personal experience of evil.

KROFT: My understanding is that you went out with this protector of yours who swore that you were his adopted godson.

    Mr. SOROS: Yes. Yes.

KROFT: Went out, in fact, and helped in the confiscation of property from the Jews.

Mr. SOROS: Yes. That’s right. Yes.

KROFT: I mean, that’s — that sounds like an experience that would send lots of people to the psychiatric couch for many, many years. Was it difficult?

Mr. SOROS: Not — not at all. Not at all. Maybe as a child you don’t — you don’t see the connection. But it was — it created no — no problem at all.

    KROFT: No feeling of guilt?

    Mr. SOROS: No.

KROFT: For example that, ‘I’m Jewish and here I am, watching these people go. I could just as easily be there. I should be there.’ None of that?

Mr. SOROS: Well, of course I c — I could be on the other side or I could be the one from whom the thing is being taken away. But there was no sense that I shouldn’t be there, because that was — well, actually, in a funny way, it’s just like in markets — that if I weren’t there — of course, I wasn’t doing it, but somebody else would — would — would be taking it away anyhow.

And it was the — whether I was there or not, I was only a spectator, the property was being taken away. So the — I had no role in taking away that property. So I had no sense of guilt.

We could nothing about the nukes…

but if they sent troops- there are millions of us “bitter clingers” that would meet them in righteous battle. We have been psychologically preparing for that day long before our fathers first allowed us to fire real rifles at age 8 or 9.

Screw the pc liberals-in many places in the US. the men teach their boys how to handle guns long before their tenth birthday. And then many of those boys go off to the military as a rite of passage.

  22. Mike Says:

Luckily when it goes to the Supreme Court we will have a “wise Latina” to make sure empathy is considered in the legal process.

We have been psychologically preparing for that day long before our fathers first allowed us to fire real rifles at age 8 or 9.

    great!

so whats your solution for anthrax given that they are now also in violation of biological warfare treaties?

whats your tactic for no prisoners and dragunov sniper shooting from over a mile away

and finally, whats your solution if they just cordon off exit and entry points, and just keep everyone inside until they starve to death (as was done a few times before).

ny city has 8 million people, only a few entry and exit points, and 4 days of food.

I would like to know what strategies and tactics you would employ given that you seem to be saying that you have actually thought through all this.

add an EMP to it all, and all cars, and pretty much all machines stop working. cant use a laser sight if the laser don’t work, can you?

I will point out aht both russia and china have a HUGE undeveloped population that has no reliance at all on electronics or modern equipment. and so given any response, they can still function.

we cant stop mexicans coming over the border (where the president said their best invention in the past 50 years was teh taco), cant be stopped

how are you going to stop the Zetas and others who have superior weapons, are more brutal, have experience.

how you going to get the 95% rate of physically unfit for any service?

as i said… our states desire to move us to a dictatorship of a proletariat bares us to other states. they disarm us, its like disarming israel or sweden, where each home has such weapons.

they hold us down for them, they pin us down for externals too. held down is held down.

but let me know how you ramp up economy and production with a economically dysfunctional society?

    totalitarian force maybe?
oh oh… there is a good reason for such to come, and not a good reason not to have it.

you just have to do a clear assessment and not care what your emotions or beliefs say, but just stick to the facts. its not a pretty site.

Suppose you were tasked with bringing down a civilization, and your only weapon was language. Could you accomplish your goal? Quite clearly, the answer is yes. To defeat a civilization language suffices if it can be used to divide man from women, parent from child, the owners of businesses from the employees, the state from the citizens, and God from the Church.

This, of course, has been the pattern of Communist subversion for the better part of a century. And even though people imagine that Communism is dead, it is very much alive.

It is impossible to understand the Left without understanding the role of the Communist Party. It is difficult to write about this subject, as most readers are not educated in the history or theory of Communism. They do not know Communist tactics, which rely on the use of language to distort meanings, to confuse and stupefy political speech and thought. As Communist generals have attested, the various “active measures” initiated by the Communist Party Soviet Union during the 1960s and 1970s, were not simply disinformation programs. The primary task was to plant ideas that would corrupt people’s thinking, leading them down a variety of false paths.

“What a difference between now and five years ago when we convened in Chicago!” he exclaimed. “At that time a Puerto Rican woman raised in the South Bronx didn’t sit on the Supreme Court. Then the president didn’t call for the abolition of nuclear weapons. Millions had no health care and no promise of it in the near future…. We weren’t in a position to fight for a progressive agenda, but on the defensive.
The pendulum of power didn’t yet tilt in favor of working people, people of color, women and their allies. And, an African American wasn’t president.

the last paragraph tells you who their army is (whether or not the army knows what they are fighting for or not!), Notice that women/race/gender/economics are THE army of the communist progressive left. If you supported any of these groups as the only answer to the problems rather than answers to problems without them, then you helped, you were a front line troop.

you were the people that the others couldnt attack as they thought you were their fellow people..

  24. Artfldgr Says:

    This in:
“They were in the buffer zone,” said MacKay, stressing that although the planes did not enter Canada’s sovereign airspace, the bombers did come inside the 300 nautical mile zone that Canada claims.
    [but WELL within EMP zone]

Attempts by Russia to test Canadian airspace have been going on since 2007; military and intelligence analysts tell QMI Agency the frequency has been increasing since then, but one senior official described Wednesday’s event as “not the usual s–t.”

The TU-95 bomber, known as the Bear, is capable of carrying nuclear weapons and may have been loaded with warheads on this trip. One military analyst tells QMI Agency the Russians have been known to fly with nukes on board just to flex their muscle and prove to the world they are still a powerful country.

    this from 2007
    http://www.telegraph.co.uk/news/uknews/1562438/RAF-jets-intercept-eight-Russian-bombers.html

This was the biggest deployment of Russian bombers to probe British air defences since the Cold War. Although the ”Bear” is obsolescent, dating from the 1950s, Russia uses it for long-range reconnaissance missions, designed to test an opponent’s reaction time.

  25. Indigo Red Says:

I was quite disturbed by the news of the ruling, However, when I read the 36 pg decision (oh, dopey me!) I didn’t care so much.

The first part that upsets folks the most is the policing the US border which may or may not be exclusively a Federal function; it’s never been decided. However, the judge left intact Arizona’s right to police who comes into the State from other States. States have the right to refuse entry to any person who has entered the US illegally through another state. If such persons are caught, presumably they must be removed to the State from which they came. The problem of the US/Mex border crossers then is that AZ cannot remove them to any State as they came from a sovereign country and, presumably, only the Feds can deport persons to a sovereign country.

The second is the new wording requiring state and local police officers to query the legal status of an individual stopped in the coarse of normal duties. However, the judge noted that police already have the legal discretionary duty to make such inquiries and let that stand.

Arizona well knew the law would receive extra scrutiny so added a severabilty clause so that when any portion were denied the remaining sections would be enforcable law.

NY City votes for the commies almost every time-they are part of the reason we are in this mess- so it would be commies starving commies-whats your point?

I would suggest you get out of the big cities-”if you want to live” . I hope Sean Hannity, and you and the other conservatives figure that out ahead of time. If we really believe the writing on the wall- we ought to be stocking up on food and guns and ammo and meds-and many are.

The gangs only survive because the ‘good guys” are not actively fighting back. In Mexico the honest are basically disarmend. The police and military are partly on the gangs side due to corruption. When they make hits in the us- it is just that- mostly hits- and then they run away.

As far as snipers? We have those too. Trick is to fight mostly in the woods.

how does militia fight organzied armies? hit- and run. just keep wearing them down- death by a thousands little cuts-like the afghans did to the Russians- and may yet do to us.

didn’t say it would be easy. Millions would die.

laser sights- like tracers- work both ways. Never seen much use for them on a hand held rifle. High tech systems perhaps but we are talking militia here.

Why can you not get it through your thick-over read skull ART? NY is not the US.! The American people are not the russians. Have we grown fat? -yes. But those millions of US military veterans are just that- Americans! Maybe they are kinda few and far between in your neck of the woods-an insignificant fraction of the populace-but then you live in New York City!

As far as the internal subversion of the constitution through a slow rate of change- thats hard to fight back against- that is what we face now- which is kinda the point of so many of these political blogs- we weep and mourn because so many of our fellow americans will not wake up to what is happening-or have been subverted themselves.

  27. jon baker Says:

Art-since you are soooo smart as you keep telling us- how is that you missed the two most obvious lessons in the last 25 years on surviving when the lights go out? You know what I am talking about? Are you ready for it? 4 words.—-”Los Angeles ” and “New Orleans”

Yet last thing I saw you are still living in NYC.

Have you taken those lesson to heart?

  28. jon baker Says:

Ok- Ok- it would bother me to see NYC surrounded and starved into submision- all those kids-but still- if you are so sure you can read the writng on the wall- why not act on it- and get out now?

  29. jon baker Says:

It would bother me about the adults too. Phooey! – I can’t be hardnosed for very long!
