  1. The judge could have upheld the law; the effect on appeals would have been unaltered. Now it goes to the Ninth Circuit, which will uphold. So today’s ruling is material in terms of immediate impact on its enforcement, and that ain’t beanbag.

  2. As we have known is coming, States’ rights are in jeopardy. Interesting times, indeed.

  3. This illegitimate ruling goes beyond the pale of merely waiting for the appeals to correct it. It should be ignored by Arizona under the natural right of civil disobedience and the rights reserved to the states under the 9th and 10th amendments.

  4. Once again, the Ninth Circuit will set itself up to be over-ridden. Once again, we will be glad (or not) for Anthony Kennedy.

    I don’t know. It looks to me as though this is really rousing people. Something had better. Anyone who thinks we’re still in “business as usual” mode needs to think again.

    Things are moving quickly, and this is simply the most visible of moves the wizards are making. There’s also the placement of the SEC behind a “No Freedom of Information Act” firewall and the DOJ’s refusal to enforce the new Military and Overseas Voter Empowerment Act. I’m all for the Republicans being just the party of “No.” At this point, someone needs to be.

    This country needs government to get out of the way – spreading opportunity – not squelching it.

    You make a good point, of course–it seems as though the more we see of Obama, the less we like him. I thought some time ago, and so did some others here, that these wizards don’t seem to care whether they’re popular among the electorate or not. They make noises sounding like they do, but mainly they just keep on running us down and laughing about it. There’s some reason for that, and I’m back to entertaining the possibility that there will come some move to suspend the elections–that, or a very well-organized effort to steal them. I had written such a possibility off for a while.

    I don’t know the stats on the matter, but I heard Rush say today that the tourist trade in Arizona is booming since they passed their immigration law–this, in spite of Leftist interest groups’ massive efforts to engineer highly publicized Arizona boycotts. It’s all propaganda, all the time. We’ve got our own American Pravda operating now, one bureau of which is named JournoList. I keep remembering that, once upon a time not that long ago, Rush was very vocal about not putting any stock in conspiracy theories. Every now and then I think I’d like to ask him whether he’s changed his mind at all on that.

    What are we going to do? I don’t know. I keep thinking–fearing, really–that it’s going to take a really huge Democrat defeat to put a dent the attacks we’re being subjected to on such multiple fronts. Failing that, I hate to think of what we might be forced into.

    Headlines like this are not meant to impart an objectively accurate understanding to the reader. They are meant to establish a meme, in this case in support of a gradual but accelerating deterioration in states rights. The left is doing this for obvious reasons, states frequently act as barriers to implementation of the left’s agenda.

    Increasing the reach of the federal government is critical to the left’s agenda and that requires that any area where state rights impede upon that agenda be countered.

    The US Constitution, which empowers the states is simply the greatest barrier to that agenda and thus must be attacked through every available venue and tactic.

    Attack the authority of the states and you attack the Constitution by ‘evolving it’ into something unrecognizable; a ‘living document’ that effectively denies individual liberty in favor of “social justice”. ‘Justice’ that conveniently and permanently leaves the left with the power to define political correctness and acceptable social policy.

    I see no alternative to a reverse Cloward-Pliven, a massive refusal to play by the rules imposed by the Left. Massive refusal to pay taxes (especially sales and property), the return to an all-cash payment and barter for transactions. Screw the 1099s for all business transactions over $600. It will take a lot of steady souls to make this happen.
    My small business vendors are already often happy to grant a 15-20% discount for cash. I am happy to oblige.

  9. Other states are not going to sit by and let them turn the most powerful country into a dictatorship of the people, which tends to move towards a war socialism. if not, then there wont be enough economy and experience to make whats needed domestically.

    if you look at everything written, it ignores the outer other. either because that’s the guiding hand, or because they don’t think that what they do changes the situation umbrella they think they are under.

    they have nationalized a lot more than we realize.
    and GM is now buying companies. think for a second as to how they are too big to fail as we own them. and so now they can swallow up others? for each they do the state ownership expands. no?

    Figure it this way. The Mexicans who come here are the most energetic, pro-active, risk-taking, ambitious, daring, motivated people in the country.
    If they weren’t allowed out (sent out) of Mexico, if they were restricted in their efforts to Mexico, the roof would come off in short order.

My immediate response to the ruling was to state that the judge has declared the will of Obama is greater than the law: his policies are now supreme over the law: this malefactor of “judge” has, until she is overturned [maybe; but its a long time until then — even so, it will be a sufficient length of time in order for Obama to consolidate his position], made Obama Dictator.

    Whatever you think of God and prophecy, the invasion of this nation and its occupation by Russia has been foretold for several decades now: it has gotten to the point where the Russian’s invasion routes have been mapped out.
    These prophecies are accompanied by others which indicate the Chinese along with the Japanese[!?] also invade. At least eight Central American and South American nations abet the invading armies: some by serving as bases for missile launches.

    but if they sent troops- there are millions of us “bitter clingers” that would meet them in righteous battle. We have been psychologically preparing for that day long before our fathers first allowed us to fire real rifles at age 8 or 9.

    Screw the pc liberals-in many places in the US. the men teach their boys how to handle guns long before their tenth birthday. And then many of those boys go off to the military as a rite of passage.

    add an EMP to it all, and all cars, and pretty much all machines stop working. cant use a laser sight if the laser don’t work, can you?

    I will point out aht both russia and china have a HUGE undeveloped population that has no reliance at all on electronics or modern equipment. and so given any response, they can still function.

    the last paragraph tells you who their army is (whether or not the army knows what they are fighting for or not!), Notice that women/race/gender/economics are THE army of the communist progressive left.   24. I was quite disturbed by the news of the ruling, However, when I read the 36 pg decision (oh, dopey me!) I didn’t care so much.

    The first part that upsets folks the most is the policing the US border which may or may not be exclusively a Federal function; it’s never been decided. However, the judge left intact Arizona’s right to police who comes into the State from other States. States have the right to refuse entry to any person who has entered the US illegally through another state. If such persons are caught, presumably they must be removed to the State from which they came. The problem of the US/Mex border crossers then is that AZ cannot remove them to any State as they came from a sovereign country and, presumably, only the Feds can deport persons to a sovereign country.

    The second is the new wording requiring state and local police officers to query the legal status of an individual stopped in the coarse of normal duties. However, the judge noted that police already have the legal discretionary duty to make such inquiries and let that stand.

    Arizona well knew the law would receive extra scrutiny so added a severabilty clause so that when any portion were denied the remaining sections would be enforcable law.

    NY City votes for the commies almost every time-they are part of the reason we are in this mess- so it would be commies starving commies-whats your point?

    I would suggest you get out of the big cities-“if you want to live” . I hope Sean Hannity, and you and the other conservatives figure that out ahead of time. If we really believe the writing on the wall- we ought to be stocking up on food and guns and ammo and meds-and many are.

    The gangs only survive because the ‘good guys” are not actively fighting back. In Mexico the honest are basically disarmend. The police and military are partly on the gangs side due to corruption. When they make hits in the us- it is just that- mostly hits- and then they run away.

    As far as snipers? We have those too. Trick is to fight mostly in the woods.

    Why can you not get it through your thick-over read skull ART? NY is not the US.! The American people are not the russians. Have we grown fat? -yes. But those millions of US military veterans are just that- Americans! Maybe they are kinda few and far between in your neck of the woods-an insignificant fraction of the populace-but then you live in New York City!

    As far as the internal subversion of the constitution through a slow rate of change- thats hard to fight back against- that is what we face now- which is kinda the point of so many of these political blogs- we weep and mourn because so many of our fellow americans will not wake up to what is happening-or have been subverted themselves.
